Moving Decoded: “Broom Clean” & Other Considerations on Moving In/Out

Movingis a big job, and it encompasses more than just the physical part of packing and transporting reusable plastic moving boxes from one place to another in the GTA. There are legalities involved, and obligations, whether you are moving in or moving out, as landlord, tenant, or homeowner. Here are some important things to keep in mind.

Broom Clean & Broom Swept

You may find these terms in your rental and sometimes even in a clause of a home sale contract. It refers to the state that a room, apartment, or dwelling is supposed to be left in. There is no exact legal definition of either term.

  • For renters – broom clean means the apartment should be left in the same condition as when you moved in, with the exception of reasonable wear and tear over the period of your stay. That means clean it once it’s empty. You’ll also need to take down and/or fix small alterations like nail holes, or curtain rods that you have installed. Taking a picture as you leave for the last time gives you your proof.

  • For homeowners – the requirements are actually less strict, and cleaning for the new owner is a courtesy. Your contract of sale may specify otherwise, and may also stipulate that all items, including that junk you’ve gathered in the basement, be removed.

Deposit or damages?

In the province of Ontario, the landlord is legally only allowed to ask for the last month’s rent when you move in – not a security deposit.

  • When you move out, they are likewise legally required to use those funds only as the last month’s rent, and not for any damages they may claim to the apartment.

  • If there is a difference between the deposit you paid and your current rent when you move, your landlord may ask you for the difference; however, they are also required to pay you accumulated interest on that deposit for the duration of your residence, so the calculation is a little more complicated than that.

  • The landlord can charge additional damages depending on the condition of the apartment and length of stay. Normal wear and tear is excluded. That’s why it’s a good idea to get some pics of the place as you move in. The Residential Tenancies Act requires that the tenant maintain the premises to a standard of "ordinary cleanliness”.
